ON RECONSIDERING THE SEX/GENDER, AS A KEY ELEMENT FOR DETERMINING LEGAL PERSONALITY, IN RELATION TO THE ELEMENTS OF IDENTITY FORMATION

In the modern world acting legal certainty is not corresponding to those challenges that the idea of equality, at a glance an obvious notion for everyone, is currently facing. The idea of equality is unrealized in the conditions, where human being faces the legal/law factuality that does not take a person into account as the subject of equal rights; and the framework of existing law/legal factuality forces the parents of an infant to obey it, and that in most cases becomes the reason of infant’s future trauma.
